In These Terms & Conditions: 

Contract Shall mean the Contract between the Company and the Customer.

Company, Us Shall mean Gremlin Racetech.

Customer, You Shall mean the person, firm or company identified in or by means of the Contract as ordering goods.

Goods Shall mean every, or where the context so requires, any item of whatsoever nature, which the Customer buys or has agreed to buy from the Company under this Contract. 

The Contract Between Us We must receive payment of the total price for the goods and shipping that you order, before your order can be accepted. Once payment has been received by us we will confirm that your order has been accepted by sending an email to you at the email address you provide in your order. Our acceptance of your order brings into existence a legally binding contract between us. 

Our Right To Refuse Your Order We reserve the right to refuse to accept your order for any reason including, without limitation and whether or not payment has been received by us, if: Our suppliers have insufficient stock to deliver the goods you have ordered;We do not deliver to your area; or one or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers. If we do refuse your order we will notify you by e-mail and will re-credit to your account any sum deducted by us from your account as soon as possible. We will not be obliged to offer any additional compensation for disappointment suffered. 

Price The prices payable for goods that you order are as set out in our website.You may be required to pay extra for delivery and it might not be possible for us to deliver to some locations.All orders are processed in GBP (£) at the prices displayed at time of order.VAT is included in all goods and shipping calculations. 

Right For You To Cancel Your Contract To cancel your contract you must notify the Company in writing.The Company shall be entitled to full indemnity if you cancel an order, which the Company has accepted.Orders accepted by the Company may not be cancelled by you without prior written consent from Gremlin Racetech and in the event of such consent being given; the Company reserves the right to charge a cancellation fee as a condition thereof.A paper copy of notification of cancellation as evidence, and proof of posting must be kept if returning goods; you may be asked to produce them.Once you have notified the Company that you are cancelling your contract, any sum debited to the Company from your account will be re-credited to your account as soon as possible and in any event within 30 days of your order.If you cancel the contract but do not return the goods to the Company in the condition they were in when delivered to you or do not pay the costs of delivery, the Company shall be entitled to deduct the direct costs of recovering the goods from the amount to be re-credited to you. 

Delivery Of Goods To You  Once we have received payment for the goods and confirmed your order, your order will be processed.Title of goods shall not pass to the customer until paid for in full.The Company will deliver the goods ordered by you to the address you give us for delivery at the time you make your order.Delivery will be made as soon as possible after your order is accepted and in any event within 30 days of your order.If any items are out of stock, the Company will inform you of an expected delivery date, or refund any payment if the alternative date is unsatisfactory.You must provide a daytime telephone contact number, be available to accept personal delivery and sign acknowledgement of delivery, alternatively nominate a house number where the parcel can be left or have it delivered to a works address.You will become the owner of the goods you have ordered when they have been delivered to you. Once goods have been delivered to you they will be held at your own risk and this Company will not be liable for their loss or destruction.We cannot guarantee delivery for a certain day or time but we will endeavour to make delivery within two working days.Delivery of goods in good condition is the responsibility of the carrier.  Should your order arrive in damaged condition, immediately inform your local carrier.All damages and/or shortages must be reported in writing (including email) within 5 days of parcel receipt in order to sustain a valid claim. Be sure to keep your original box and packing material. 

Returns To return a product, you must first contact the Company (gremlinracetech@aol.com) for approval, a returns number and form.Returns will not be accepted without a returns number obtained in advance, and a completed Gremlin Racetech returns form.Returns will be credited at your cost, postage fees are non refundable.Full credit or replacement, at our discretion, will be allowed in cases where the goods are returned because of obviously faulty workmanship or an error on the part of the Company or our associates.The Company will not accept any electrical parts for credit that have been installed and run, unless we can prove beyond doubt that the electrical part involved is in fact defective and only then will the Company request either repair or replacement for the defective item from the manufacturer.All parts returned must be in "as new" condition.Parts returned must be in original packaging.Returned products are the responsibility of the Customer, until received by Gremlin Racetech.All goods returned no longer wanted or incorrectly ordered by the Customer, will be subject to a 25% restocking and administration charge.Goods ordered to customers specifications are non-returnable/refundable.  

Warranty All goods are only guaranteed in accordance with the manufacturers own terms of warranty.Claims evaluation will be made in a just and prompt manner by the manufacturer.All implied warranties, including, but not limited to implied warranties of the fitness and merchantability, are limited in duration to a period ending one year from the date of purchase, unless otherwise specified.Under no circumstances will the Company be responsible for incidental or consequential damages arising from, or in connection with, the installation or use of any product distributed by the Company.The manufacturers shall be solely responsible for any damage to person or property arising from the design, manufacture, testing and use of its products, and Gremlin Racetech accept no liability for such damages.Warranty is void if an item is altered, misused or installed improperly.Due to conditions beyond our control, chrome cannot be guaranteed after it is placed in service.

Events Beyond Our Control In the case of ordered goods the Company will use its best endeavours to ensure availability of the same by the date and time requested.  However, the Company can offer no guarantee with respect to the provision of this clause and cannot accept responsibility for delay resulting from the none or late availability of any goods or other reasons beyond its control. 

Governing Law The contract between us shall be governed by and interpreted in accordance with English law and the English courts shall have jurisdiction to resolve any disputes between us. Cancellation rights under Distance Selling laws apply. 

Entire Agreement These terms and conditions, together with our current website prices, delivery details, contact details and privacy policy, set out the whole of our agreement relating to the supply of the goods to you by us.
